Terms of Service for Lifelog

1. Acceptance of Terms
By downloading, installing, or using Lifelog ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Lifelog is a personal audio diary application that allows you to:
- Record audio diary entries
- Store recordings securely in the cloud
- Automatically transcribe recordings into readable text
- Play back recordings with synchronized transcript highlighting
- Organize and search your diary entries
3. Account Registration
3.1 Sign in
You sign in to Lifelog with Google or Sign in with Apple. You are responsible for keeping your sign-in credentials secure and for activity on your account.
3.2 Account Eligibility
- You must be at least 13 years old to use Lifelog
- You must provide accurate and complete information
- You may only create one account per person
- You may not share your account with others
3.3 Account Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You use the App for illegal activities
- Your account is inactive for an extended period
- We discontinue the service
4. User Content
4.1 Your Recordings
You retain all ownership rights to the audio recordings and transcripts you create ("User Content"). By using Lifelog, you grant us a limited license to:
- Store your recordings on our servers
- Process your audio for transcription
- Display your content back to you within the App
- Perform technical operations necessary to provide the service
4.2 Content Responsibility
You are solely responsible for your User Content. You agree that your recordings will not:
- Violate any laws or regulations
- Infringe on intellectual property rights of others
- Contain harmful, threatening, or harassing content
- Contain malware or malicious code
- Be used to impersonate others or misrepresent your identity
4.3 Content Removal
We reserve the right to remove any User Content that violates these Terms, though we do not actively monitor user content. Your audio diary is private and personal to you.
4.4 Backup Responsibility
While we take reasonable measures to backup your data, you are responsible for maintaining your own backups of important recordings.
5. Subscription and Payments
5.1 Premium Subscription (If Applicable)
Lifelog may offer premium subscription plans:
- Monthly Subscription: $6.99/month
- Annual Subscription: $34.99/year
5.2 Billing
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Payment will be charged to your Apple ID Account at confirmation of purchase
- You can manage subscriptions and turn off auto-renewal in your Account Settings
- No refunds for partial subscription periods
5.3 Free Trial
If offered, free trials automatically convert to paid subscriptions unless canceled before the trial period ends.
5.4 Price Changes
We reserve the right to change subscription prices with 30 days notice. Price changes will not affect current subscribers until their next renewal period.
6. Acceptable Use Policy
You agree NOT to:
- Use the App for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Reverse engineer, decompile, or disassemble the App
- Remove or modify any copyright notices or proprietary markings
- Use automated systems (bots) to access the App
- Interfere with or disrupt the App's functionality
- Violate any applicable laws or regulations
7. Intellectual Property
7.1 Our Rights
Lifelog, including its design, features, code, and trademarks, is owned by Michael Perusse and protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
8. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.
9. Third-Party Services
Lifelog uses third-party services:
- Supabase for backend infrastructure
- AssemblyAI for audio transcription
- Google OAuth for authentication
These services have their own terms and privacy policies. We are not responsible for the practices of these third-party providers.
10. Disclaimers and Limitations of Liability
10.1 "As Is" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10.2 No Guarantee of Availability
We do not guarantee that:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App is free of viruses or harmful components
- Transcriptions will be 100% accurate
10.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of data, recordings, or transcripts
- Loss of profits or revenue
- Service interruptions or data breaches
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE LAST 12 MONTHS, OR $100, WHICHEVER IS LESS.
11. Indemnification
You agree to indemnify and hold harmless Lifelog and Michael Perusse from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your User Content
- Your use or misuse of the App
12. Termination
12.1 Your Right to Terminate
You may stop using the App at any time and delete your account from the Settings screen.
12.2 Our Right to Terminate
We may suspend or terminate your access to the App:
- For violation of these Terms
- For fraudulent or illegal activity
- If we discontinue the service
12.3 Effect of Termination
Upon termination:
- Your right to use the App will immediately cease
- Your data will be deleted according to our Privacy Policy
- Subscription fees already paid are non-refundable
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by:
- Posting updated Terms in the App
- Updating the "Last Updated" date
- Sending an email notification (for significant changes)
Your continued use of the App after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
15. Dispute Resolution
15.1 Informal Resolution
Before filing a claim, you agree to contact us to attempt informal resolution.
15.2 Arbitration
Any disputes that cannot be resolved informally will be resolved through binding arbitration under the American Arbitration Association (AAA) rules, rather than in court.
15.3 Class Action Waiver
You agree to resolve disputes individually and waive your right to participate in class action lawsuits.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lifelog.
16.2 Severability
If any provision of these Terms is found invalid, the remaining provisions will remain in effect.
16.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
16.4 Assignment
You may not assign these Terms. We may assign our rights and obligations to any party at any time.
16.5 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control (e.g., natural disasters, government actions, internet outages).

18. App Store Terms
Your use of Lifelog is also subject to the Apple App Store Terms of Service. In the event of conflict between these Terms and the App Store terms, the App Store terms will prevail.
By using Lifelog, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
